BBC planning application 25/00755/FUL
This application as detailed on the BBC planning portal has been submitted to HML for approval and we wanted to ensure that residents were aware of the details.
The land currently consists of two original building plots, each with a separate transfer in the Land Registry title, containing a covenant restricting the use of each plot for one house. On that basis HML cannot restrict construction on the second building plot.
This differs from, for example, a single plot with a restriction allowing only one house to be erected where there is a proposal for two houses. In that case there would be a clear breach of the covenant.
As the proposed new house comfortably meets the HML planning guidelines in all respects the Directors have given HML approval to the proposed new house.
For good governance to avoid any conflict of interest, as the plots are owned by one of the HML serving directors, that director was excluded from any discussion and decision in relation to the approval.
